Petitioner seeks to set aside an order of the National Labor Relations Board wherein it was found to have violated Sections 8(a)(1), (3), and (5) of the National Labor Relations Act. 29 U.S.C. Â§ 158. The conduct of which complaint was made was the layoff of employees resulting from the gradual tapering off of production by petitioner, looking to cessation of operation contemporaneously with the expiration of an existing collective bargaining agreement. The Board found that these actions necessarily discouraged union membership, interfered with protected employee rights within the purview of Section 7 of the Act, and aborted the bargaining process.
